Fan Terms
version 2026-09-20
1. About the Fan Terms
These terms apply when you send a song request to a performer on thegig.live. They add to the Common Terms. If they differ, these terms apply to your use as a fan.
We may update these terms. When we do, the version at the top of the page changes, and we ask you to accept the new version. See section 12 of the Common Terms.
In these terms:
- Performer is the person or act whose page you are on.
- Request is a song you ask a Performer to play, with any note you add.
2. Signing in to send a request
You can look at a Performer's page and song list without an account. You sign in only when you send a Request. You can do this with one tap using Google, or with a code we send to your email. You do not need to fill in a profile.
We show the Performer the name from your sign-in, so that they know who is asking.
3. What you send in a Request
A Request is content you post. The Performer and their team can see it. Keep your note short and kind. Do not put in it anything that is illegal, hateful or threatening, or personal details about other people.
Requests are moderated. A Performer can decline any Request. We may remove a Request or a note that breaks these terms or the Common Terms.
You allow the Performer and us to use your Request to run the show and the Service. For example, we show it in the Performer's queue, in your list of Requests, and in the Performer's record of the gig.
4. No Request is guaranteed to be played
A Request is a polite ask. It is not an order. The Performer decides what to play and when. They may say no, leave a song for later, or not play it at all, for any reason, and they do not have to tell you why. A Request may end as "not played this time".
We do not promise that a Request will be played. We do not promise that a Performer will use the Service at any gig. Performers are not our employees or agents. We are not responsible if a song is not played.
5. Conduct toward performers and other fans
Be respectful.
- Do not harass, threaten or insult a Performer, venue staff or other fans, including in a note.
- Do not pretend to be someone else.
- Do not send the same Request again and again to pressure a Performer.
- Do not use the Service to disturb the show.
Follow the rules of the venue.
6. Limits and muting
To keep Requests fair, a Performer can set limits, for example how many Requests you can have open at one time, or a short wait between Requests. We may also set limits.
A Performer can mute you for a gig. If they do, they may not see your Requests, and you may not be told. We may block you from sending Requests if you break these terms.
7. One account, no automated use
Use one account. Do not use more than one account, or another person's account, or bots, scripts or other automated tools to send Requests or to get around limits.
8. Your information
The Performer receives your name, your song choice and your note. They may use this only to run the show and to answer your Request. We keep a list of your Requests so that you can see them. Our Privacy Notice, at thegig.live/privacy, explains more.
9. Stopping
You can stop using the Service at any time. You may ask us to delete your account. Requests you sent may stay in a Performer's record of past gigs, as our Privacy Notice explains.
Common Terms
version 2026-09-20
1. About these terms
These terms apply when you use thegig.live (the "Service"). The Service helps performers take song requests from their audience. "We" and "us" mean thegig.live, which runs the Service. "You" means the person using it.
Performers also accept the Artist Terms. People who send song requests also accept the Fan Terms. If one of those documents says something different for its role, that document applies to that role.
By ticking the box to agree, or by using the Service after we tell you about these terms, you agree to them. If you do not agree, do not use the Service.
We may update these terms. When we do, the version at the top of the page changes, and we ask you to accept the new version before your next action that needs it. See section 12.
2. Who can use the Service
You must be old enough to make a binding agreement where you live. If you are younger, a parent or guardian must agree for you. Do not use the Service if the law where you live does not allow it.
3. Your account and sign-in
You sign in with a sign-in provider, such as Google, or with a code we send to your email. We receive only what we need from the provider, such as your name and email address. We never see your password for a provider.
Give correct information. Keep your access secure. You are responsible for what happens under your account. Tell us quickly if someone else uses it.
4. Acceptable use
Do not use the Service to:
- break the law, or help someone else break it;
- harass, threaten, abuse or discriminate against anyone;
- pretend to be another person, band or organisation, or mislead people about who you are;
- post content that is illegal, hateful, or that sexually exploits or endangers anyone, especially children;
- post content you do not have the right to post;
- send spam, or use bots, scripts or bulk tools, unless we agree;
- break, overload or get around the security or limits of the Service, or reach data that is not yours;
- copy, scrape, resell or reverse engineer the Service.
If you break this section, we may remove content, and limit or end your access.
5. Content and rights
Your content. You keep ownership of what you post ("Your Content"). You are responsible for it, and you confirm that you have the right to post it. You allow us to use it to run the Service, as the Artist Terms and Fan Terms explain.
Our rights. The Service, its software, design, name and logos belong to us or to those who license them to us. We give you a limited, personal, non-exclusive right to use the Service as these terms allow. Nothing else is transferred to you.
Ideas. If you send us ideas or feedback, we may use them without paying you.
Complaints about content. If you think something on the Service breaks your rights or these terms, contact us. Tell us the address of the page, what is wrong, and who you are. We will look at it and may remove the content.
6. Personal data
We use personal data to run the Service, keep it safe, and contact you about it. Our Privacy Notice, at thegig.live/privacy, explains what we collect, why, who we share it with, how long we keep it, and what choices you have.
7. Other services
The Service uses services run by others, for example sign-in providers, email delivery and hosting. Their own terms and privacy notices apply when you use them. We are not responsible for services we do not run, or for other websites we link to.
8. Availability and changes to the Service
We work to keep the Service running. We do not promise that it will always be available or free of errors. We may change, pause or stop parts of the Service. If a change will seriously affect you, we will try to tell you first.
Do not rely on the Service as the only way to do something important.
Fees. Today, the features of the Service are free. We may add new features later, and some of them may need a paid subscription. We will tell you clearly before you are charged for anything, and we will not charge you unless you agree.
9. Suspending and ending
You can stop using the Service at any time.
We may suspend or end your access, remove content, or limit features if:
- you break these terms;
- the law requires it;
- your use creates a risk or harm for us, the Service or other people; or
- we stop the Service or a feature.
Where it is reasonable, we will tell you why. Parts of these terms that are meant to continue, such as ownership, disclaimers, limits of responsibility and governing law, continue after your access ends.
10. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we make no promises about it, stated or implied. This includes any promise that it will meet your needs, work without interruption, that a request will be played, or that a gig will take place.
We do not check requests, gig details or performers. We are not a party to any arrangement between a performer, a fan and a venue.
11. Limits of our responsibility
To the extent the law allows:
- we are not responsible for indirect loss, or for loss we could not reasonably have foreseen, including lost income, lost bookings and lost data; and
- our total responsibility to you for all claims is limited to the amount you paid us for the Service in the 12 months before the claim. This may be nothing.
Nothing in these terms limits responsibility that the law does not allow us to limit, for example for death or personal injury caused by our negligence, or for fraud. You may have rights under the law where you live that a contract cannot remove. These terms do not remove them.
12. Changes to these terms
We may update these terms at any time, for example when the Service changes or the law changes. Each document has a version, and each document changes on its own. When a document changes, we show you the new version and ask you to accept it before your next action that needs it. If you do not accept, you cannot take that action. You can still stop using the Service.
13. Governing law and disputes
These terms, and any dispute about them or the Service, are governed by the law of the place where the operator of thegig.live is established. Rules of your local law that protect you, and that a contract cannot change, still apply to you.
If you have a problem, please contact us first and give us a chance to solve it. If it cannot be solved, the courts of that place may decide it, unless your local law lets you bring a claim where you live.
14. General
- Language. We may translate these terms. If the translation and the English text differ, the English text applies.
- Whole agreement. These terms, the role documents that apply to you, and the Privacy Notice are the whole agreement between you and us about the Service.
- If part is invalid. If a part of these terms cannot be enforced, the rest still applies.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Transfer. You may not transfer your rights under these terms. We may transfer ours if the business that runs the Service changes, and we will tell you.
15. Contact
You can contact us through the contact details on thegig.live. We contact you at the email address you signed in with, or inside the Service.
